Ayopgi Privacy Policy

PT Ayo Pgi Indonesia (“Ayopgi”) values our customers and respects their privacy. This Privacy Policy describes Ayopgi’s policies on the collection, use, and disclosure of information about you in connection with your use of Ayopgi website, emails, Ayopgi Service Platform, or any applications (including mobile applications) made available by Ayopgi (collectively, “Platform”). When you use the Platform, you consent to our collection, use, and disclosure of information about you as described in this Privacy Policy.

This Privacy Policy sets forth the nature, purpose, use and sharing of any personal information that identifies or can be used to identify you, the visitors to our Platform and users of our Services, as well as non-personally identifiable information that we may collect whenever you interact with our Platform or Services. This Privacy Policy does not govern privacy practices associated with offline activities, websites other than the Platform, or practices of third parties that we do not own or control, such as our partners, third party service providers featured on the Platform or advertisers. In order to access such third party’s products and services, you may be required to provide personal information to such third parties or agree to allow Ayopgi to share your personal information with the third parties. Unless expressly provided to the contrary, personal information that you provide while you are visiting a Third Party Site will be subject to the privacy policy posted on that site, and personal information that you provide while on the Third Party Site will be subject to this Privacy Policy. If you have objections to the Privacy Policy, you should immediately discontinue use of the Platform.

Information Collection and Uses

1. We may collect and store information about you when you register to the Platform or subscribe to our Services, including full name, email address, other personal information and any other User Content you posted or submit to the Platform. We use the information to fulfill your requests, provide the Platform’s functionality, improve the Platform’s quality, personalize your experience, track usage of the Platform, provide feedback to third party businesses that are listed on the Platform, display relevant advertising, market the Platform, provide customer support, communicate with you, back up our systems and allow for disaster recovery, enhance Platform’s security and comply with legal obligations.
2. We also collect any information that you contribute thought the Platform what is intended for public consumption, including your reviews, comments, tips, photos, videos, likes, approves, friends, account profile and any other content you posted or submit to the Platform. We may display this information through the Platform, share it with businesses, and further distribute it to a wider audience through third party sites and services.
3. When you are inviting your friends to join the Platform, you agree that you are providing us with their contact information, or by allowing us to access your contacts from your computer, mobile devices, any other devices/gadgets or third party sites to select which friends you want to invite. If you allow us to access your contacts, we may transmit that information to Ayopgi long enough to process your invitations.
4. We may automatically collect and store information about your use of the Platform, such as your search activity, the pages you view, click pattern, date and time of visit, business you call using the Platform, and reservations and purchase order you make through the Platform. We also may collect and store information that your computer, mobile device or gadget provides to us in connection with your use of the Platform, such as your browser type, type of computer or mobile device, gadget, browser language, IP address, mobile carrier, phone number, unique device identifier, advertising identifier, location (including geolocation, beacon based location, and GPD location), and requested and referring URLs. You may be able to disallow out use of certain location data through your device or browser settings.
5. We may on occasion supplement or correct the personal information you submit to us and your IP address with information in our databases or information from third-party sources in order to reduce errors in our database, authenticate our users, prevent fraud and prevent abuse of the Platform, as well as to provide a better, more consistent and relevant experiences for our users.
6. When you register to the Platform, you are opting to receive messagems from other Ayopgi users, businesses and Ayopgi itself. You may manage some of your messaging preferences, but you cannot opt out of receiving certain administrative, transactional or legal messages from Ayopgi. We may also track your actions in response to the messages you receive from Ayopgi or through the Platform, such as whether you deleted, opened, or forwarded such messages. If you exchange messages with others through the Platform, we may store them in order to process and deliver them, allow you to manage them, and review and disclose them in connection with investigations related to the operation and use of the Platform. We may not deliver messages that we believe are objectionable, such as spam messages or requests to exchange reviews for compensation. If you send or receive messages through the Platform via SMS text message, we may log phone numbers, phone carriers and the date and time the messages were processed. Carriers may charge recipients for texts that they receive. We also may collect and store information that you provide through communications to us, including from phone calls, letter, emails and other electronic messages, or in person.
7. When you initiate a reservation or purchase (collectively, “Transaction”) through the Platform, we may collect and store your personal information, such as your full name, phone number, address, email, credit card information, as well as any other information you provide us, in order to process your Transactions, send communications about the Transactions to you and populate forms for your future Transactions. This information may be shared with third parties for the same purposes. When you submit credit card number, we encrypt that information using industry standard technology. If you write comments or reviews about information, data, commentary, communications, downloads, files, text, images, graphics, videos, audio, links, publications, content, tools, resources, programs and products that you post or submit to, or otherwise make available on the Platform (“Use Content”) or business with which you transact through the Platform, we may publicly display the fact that you transacted with those User Content or businesses.

Cookies

1. Ayopgi and third parties with whom we partner, may use cookies, web beacons, tags, scripts, local shared objects such as HTML5 and Flash (also called “flash cookies”), advertising identifiers (including mobile identifiers such as Apple’s IDFA or Google’s Advertising ID) and similar technology (“Cookies”) in connection with your use of the Platform, third party websites, mobile applications and gadgets. Cookies may have unique identifiers, and reside, among other places, on your computer, mobile devices or gadgets, in emails we send to you, and on our web pages. Cookies may transmit information about you and your use of the Platform, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. Cookies may be persistent or stored only during an individual session.
2. It may be possible to disable some (but not all) Cookies through your device or browser settings, but doing so may affect the functionality of the Platform. The method for disabling Cookies may vary by device and browser, but can usually be found in preferences or security settings. Please note that changing any of these settings does not prevent the display of all advertisements to you.

Your Personal Data

1. You can always choose not to provide information when you are prompted to do so. Note that if you do not provide us with certain mandatory information, then you may be unable to access our Platform or take advantage of certain features on the Platform.
2. If at any time you are uncomfortable with our use of your personal information for internal marketing purposes, you may opt-out by telephone, mail or email. As discussed above, if you choose to opt-out, then the Platform may be unavailable to you.
3. You have the right to access, correct and delete inaccuracies in your personal information and privacy preferences on the Platform at any time by signing into your account and editing your personal information in your account profile.
4. You may also opt-out of receiving communications from us, although we may find it necessary to continue to communicate with you regarding your use of the Platform.

Data Retention

When you close your account, well will remove your public post from view and/or dissociate them from your account profile, but we may retain information about you for the purposes authorized under this Privacy Policy unless prohibited by law. Please note that businesses cannot remove their business listings, ratings, or reviews by closing their accounts.

Third Parties

1. We may share your personal information with our third party services providers as described in the section “Information Collection and Uses”.
2. We may share your personal information when required by law, regulation, or litigation, and as necessary for purposes of national security, law enforcement, or other issues of public importance. However, this would be carried out case by case subject to the approval of Ayopgi Board Members and Directors.
3. We may share user information in the aggregate with third parties, such as advertisers and content distributors.
4. This Platform may contain links to unaffiliated third party services. Except as set forth herein, we do not share your personal information with them, are not responsible for their privacy practices. We suggest you read the privacy policies on or applicable to all such third services.
5. If you sign up for Ayopgi using a third party service like Facebook, or link your Ayopgi account to your account with a third party service, we may receive information about you from such third party service.
6. If Ayopgi sells assets or is acquired by or merged with another entity, we may provide such entity customer information without obtaining your further consent. We may provide notice of such asset sales, acquisitions, or mergers on this Platform.

Children

Persons under the age of 18 are not eligible to purchase, cancel or modify any services available through Ayopgi.

Security

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, even though we strive our best to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Modification To Privacy Policy

We reserve the rights to revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our collection, storage, use and disclosure of information about you. If we make material changes to this Privacy Policy, we will notify you by email or by posting a notice on the Platform prior to the effective date of the changes. By continuing to access or use the Platform after those changes become effective, you agree to the revised Privacy Policy.

Governing Law

This Privacy Policy is governed by and to be construed under the laws of the Republic of Indonesia. Any and all disputes arising from this Privacy Policy shall be governed by the exclusive jurisdiction of the South Jakarta District Court.

California Privacy Rights

California Civil Code Section 1798.83 permits customers of Ayopgi who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purpose. To make such a request, please write to us at the following address:
